Arklavo Intellectual Property and Acceptable Use Policy

This Intellectual Property and Acceptable Use Policy ("Policy") governs your use of Arklavo's website, customization tools, upload features, and related services (the "Services"). This Policy forms part of and is subject to our Terms of Service.
1. Ownership of Arklavo Intellectual Property
All content on our Website, including but not limited to text, graphics, product images, garment templates, design tools, layouts, software, branding, and trademarks ("Arklavo Content"), is owned by or licensed to Arklavo and is protected by intellectual property laws. You may not copy, reproduce, modify, distribute, scrape, reverse engineer, or exploit Arklavo Content without our prior written consent.
2. Customer Content
"Customer Content" means any logos, trademarks, text, artwork, images, designs, or other materials you upload, submit, approve, or provide for customization. You retain ownership of your Customer Content. However, by submitting Customer Content, you represent and warrant that:
- You own the content or have obtained all necessary rights, licenses, and permissions to use it for the intended purpose;
- The content does not infringe, misappropriate, or violate any third-party intellectual property, privacy, publicity, or other legal rights;
- The content is lawful and does not violate any applicable law or regulation; and
- The content complies with this Policy.
3. License to Arklavo
You grant Arklavo a limited, worldwide, royalty-free license to use, reproduce, modify (as reasonably necessary for formatting or production), display, and process your Customer Content solely for the purpose of:
- Creating proofs or mockups;
- Manufacturing customized products;
- Quality control;
- Fulfilling and shipping orders;
- Providing customer support; and
- Complying with legal obligations.
We will not use your Customer Content for marketing or promotional purposes without your consent, except as otherwise permitted by law.
4. Prohibited Content
You may not upload, submit, or request production of any content that:
A. Infringing or Counterfeit Content
- Uses trademarks, logos, or brand names without authorization;
- Reproduces copyrighted images, artwork, or designs without permission;
- Infringes patents, trade dress, or other proprietary rights;
- Involves counterfeit goods or replica branding.
B. Unlawful or Harmful Content
- Violates any law or regulation;
- Promotes illegal activity;
- Contains hate speech, extremist symbols, or discriminatory content;
- Contains obscene, sexually explicit, or abusive material;
- Incites violence or harassment.
C. Misleading or Fraudulent Content
- Impersonates a business, organization, or individual without authorization;
- Uses official insignia (e.g., government, law enforcement, military) without lawful permission;
- Includes false endorsements or deceptive claims.
5. Right to Refuse or Cancel Orders
Arklavo reserves the right, in its sole discretion, to:
- Refuse to produce any content;
- Request proof of authorization for logos or trademarks;
- Suspend or cancel orders;
- Remove content;
- Terminate accounts;
where we reasonably believe Customer Content violates this Policy, applicable law, or third-party rights.
We are not obligated to review or verify Customer Content prior to production, and our decision to proceed with an order does not constitute approval or confirmation of your legal rights to use the content.
6. Repeat Infringement
We may suspend or terminate accounts of users who repeatedly submit infringing or prohibited content, consistent with applicable law and our DMCA Policy.
7. Intellectual Property Claims
If you believe content produced or made available through our Services infringes your intellectual property rights:
- Copyright claims must follow our DMCA Policy at /pages/dmca-policy.
- Trademark or other IP concerns may be submitted to: info@arklavo.com.
We will review complaints in accordance with applicable law.
8. No Obligation to Monitor
We are not required to monitor Customer Content but reserve the right to do so. Failure to remove or refuse content does not waive our rights or create liability.
9. Indemnification
Business Customers agree to indemnify and hold harmless Arklavo and its affiliates from claims arising from Customer Content or violations of this Policy.
Consumers may be responsible for losses directly caused by their breach of this Policy, to the extent permitted by law.
10. Modifications
We may update this Policy from time to time. Continued use of the Services after changes take effect constitutes acceptance of the revised Policy.
