1. Overview
Arklavo ("Arklavo," "Company," "we," "us," or "our") respects the intellectual property rights of others and expects users of our Website and Services to do the same. This Digital Millennium Copyright Act Policy ("DMCA Policy") describes the procedures we follow in accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) when we receive notifications of claimed copyright infringement relating to content made available through our Website or Services. This DMCA Policy is provided for informational purposes and does not create contractual rights beyond those provided under applicable law.
2. Repeat Infringer Policy
In accordance with the DMCA, we have adopted and reasonably implement a policy providing for the termination, in appropriate circumstances, of users who are deemed to be repeat infringers. A repeat infringer may include a user who has been the subject of multiple valid DMCA notices. We reserve the right, in our sole discretion and consistent with applicable law, to suspend or terminate accounts where we determine infringement has occurred.
3. Submitting a DMCA Notice of Claimed Infringement
If you believe that material available on or through our Website infringes your copyright, you may submit a written notification to our Designated Copyright Agent that includes the following information (as required by 17 U.S.C. § 512(c)(3)):
- A physical or electronic signature of a person authorized to act on behalf of the copyright owner;
- Identification of the copyrighted work claimed to have been infringed;
- Identification of the allegedly infringing material and information reasonably sufficient to permit us to locate it (including specific URLs);
- Your contact information, including address, telephone number, and email address;
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law; and
- A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.
Notices that fail to comply substantially with these requirements may not be processed.
